This guidance document has been prepared to outline the certificate of contamination audit scheme. This scheme will enable landowners, developers, financiers or recipients of regulatory notices to obtain a government assurance on the contamination status of a site, or a portion of a site, and the site's suitability for a particular land-use.

This document has been prepared to assist landowners who have not caused contamination, in preparing disclosure statements for the purpose of gaining an exemption from responsibility for remediation of a contaminated site, where that site requires remediation. This guideline provides guidance to persons with an obligation or desire to report known or suspected contaminated sites to DEC in accordance with the Contaminated Sites Act 2003 (including site owners and occupiers, government authorities, industry and other affected parties). The guideline provides DEC's interpretation on when and how sites should be reported under the provisions of the Act (please note that the provisions of the Contaminated Sites Act 2003 are final, and not subject to change).
